Terms of Service
Last updated September 30, 2026
These Terms of Service (the “Terms”) are an agreement between you and Autoember Inc., a Delaware corporation doing business as Repaint (“Repaint,” “we,” or “us”). They cover your use of repaint.com, the Repaint app, and the websites, apps, and other tools you build with it (together, the “Service”).
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you use Repaint on behalf of a business, you agree to these Terms on behalf of that business, and “you” includes the business. If you don't agree, you may not use the Service.
1. Your account
- You must be at least 18 years old to use Repaint.
- You must give us accurate information and keep it up to date, including the information you provide when you set up payments.
- You're responsible for keeping your login secure and for everything that happens in your account and workspaces.
- Each person may have one free trial. You may not create additional accounts to get more free trials or free usage, to share one plan across people who should each have their own, or to return after we've suspended or banned you. We may link accounts we believe are related and take action on all of them.
Workspaces and members
Everything you build lives in a workspace. The workspace owner is responsible for the workspace, its billing, and everyone they invite. Every member of a workspace can see and change everything in it, including customer data and payment information, so the owner is responsible for the actions of every member.
2. Using Repaint
Subject to these Terms, we give you a limited, non-exclusive, non-transferable right to use the Service for your own business or personal purposes.
AI-generated work
Repaint uses AI models to build and manage your websites, apps, data, and other content. AI output can be inaccurate, incomplete, or unsuitable for your needs. You're responsible for reviewing what the AI builds and changes before you rely on it or publish it, including anything involving your customers, their data, payments, or email.
Changes to the Service
We're always changing Repaint. We may add, change, limit, or remove features, set or change usage limits, and change which AI models and providers we use, at any time. Some features may be labeled as beta and may not work as expected.
3. Plans, billing, and refunds
- Subscriptions. Paid plans are billed in advance each month and renew automatically until you cancel. You authorize us to charge your payment method for each billing period, and for any credits or upgrades you buy.
- Free trial. New workspaces may start with a free trial. We may require a payment method to start a trial, offer different trials, plans, or requirements in different regions, and change, limit, or end free trials at any time.
- Usage limits and credits. Plans include a weekly AI usage allowance and other limits described on our pricing page. Credits you buy are used after your allowance runs out. Credits have no cash value and can't be transferred.
- Price changes. We may change our prices. We'll give you notice before a price change applies to your subscription.
- Taxes. Prices don't include taxes. We may add taxes to your bill where we're required to collect them.
- Failed payments. If a subscription payment fails, we may restrict your access to the AI and other features until it's paid. If it stays unpaid, we may cancel your subscription and pause your workspace.
- Cancellation. You can cancel at any time. Your plan stays active until the end of the period you've paid for. After that, your workspace is paused. Your websites go offline, and payments, email sending, and AI chat stop working.
Refunds
Payments are non-refundable once you've used the AI allowance or credits they include. If you haven't used a paid plan or purchased credits, you can contact support to request a refund, which we may grant at our discretion. We don't give refunds when we suspend or terminate an account for violating these Terms.
4. Your content and our platform
What you own
You own the content you bring to Repaint and the content Repaint creates for you, like your text, images, and the data your sites collect (“Your Content”). You're responsible for Your Content and confirm that you have the rights to use it, and that it doesn't break the law or these Terms.
You give Repaint a worldwide, non-exclusive, royalty-free license to host, store, copy, process, display, and transmit Your Content as needed to operate, secure, support, and improve the Service. This includes sending Your Content to our AI providers and other service providers.
How we access your content
Our team and our automated tools, including AI, may access and review your workspaces, including your chats with the AI. We do this to provide support, fix problems, investigate abuse, enforce these Terms, and understand and improve how Repaint is used.
What we own
Repaint owns the Service. That includes our software, infrastructure, AI instructions and prompts, tools, templates, and the systems and formats your websites and apps run on. Websites and apps built with Repaint are made to run on Repaint, and we don't offer code export. Except for Your Content, nothing in these Terms gives you any rights in the Service.
If you send us feedback or ideas, we may use them without any obligation to you.
5. What you can't do
You may not use Repaint to build, host, send, or promote any of the following, or help anyone else do so. These are examples, not a complete list. We decide at our discretion whether something violates these Terms.
Prohibited content and businesses
- Anything illegal, including illegal products and services
- Drugs, drug paraphernalia, and marijuana or cannabis products
- Weapons, explosives, and hazardous materials
- Counterfeit goods, and content that infringes someone else's copyright, trademark, or other rights
- Adult content and sexual services, including AI-generated adult content
- Gambling, including casinos, betting, lotteries, and games of skill or chance with prizes
- Hate speech, harassment, content that promotes violence, and anything that exploits or endangers minors
- Pyramid schemes, multi-level marketing, and get-rich-quick schemes
Deception and fraud
- Impersonating any brand, business, person, bank or financial institution, or government agency, or creating sites that could be mistaken for theirs
- Phishing, or collecting passwords, payment details, or personal information under false pretenses
- Scams, including those that target older or vulnerable people
- Cloaking, or showing search engines, reviewers, or us different content than what visitors see
- Fake reviews, fake testimonials, and misleading claims
Spam
- Sending email to people who haven't agreed to hear from you, including cold outreach and purchased or scraped lists
- Sending email that generates excessive spam complaints or bounces
Abusing Repaint
- Creating or recycling accounts to get more free trials or usage, or to get around a suspension or ban
- Getting around your plan's limits, like connecting more custom domains than your plan allows by redirecting domains or DNS records to your Repaint address
- Copying, scraping, mirroring, or downloading the code, files, or infrastructure behind sites built on Repaint in order to run them anywhere else
- Reverse engineering the Service, or trying to extract our AI instructions, prompts, tools, or other internal systems
- Probing, scanning, or testing the security of the Service, or accessing it in ways we don't allow
- Overloading or interfering with our infrastructure, including mining cryptocurrency or running automated traffic
- Uploading malware or anything designed to harm people, devices, or systems
6. Accepting payments
This section applies if you use Repaint to accept payments from your customers.
Your sales are yours
When your customers pay you through a site or app built on Repaint, you are the seller and the merchant of record. Your customers buy from you, not from Repaint, and the revenue from your sales belongs to you. Repaint provides software and arranges payment processing for you. Repaint isn't a marketplace, isn't a party to your sales, and doesn't sell, list, or take ownership of your products or services.
Repaint's only earnings from your sales are its platform fees. Most of each processing fee goes to our payment processor, card networks, and banks, and Repaint keeps the rest.
Payment processing by Stripe
Payment processing services for merchants on Repaint are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (together, the “Stripe Services Agreement”). By agreeing to these Terms or continuing to operate as a merchant on Repaint, you agree to be bound by the Stripe Services Agreement, as it may be modified by Stripe from time to time. As a condition of Repaint enabling payment processing services through Stripe, you agree to provide Repaint accurate and complete information about you and your business, and you authorize Repaint to share it and transaction information related to your use of the payment processing services provided by Stripe.
Payments are only available to eligible businesses in supported countries. You must follow the rules of our payment processor and the card networks, including their lists of prohibited and restricted businesses. We may decline, limit, or turn off payments for any business at our discretion.
Fees
Each payment you accept is subject to the processing fees listed on our payment fees page. Fees are deducted automatically from each payment. We may change our fees with notice. Fees aren't returned when you refund a payment.
Payouts
We send payouts to your bank account after your account is approved and on the schedule we set. We may review your account at any time. We may delay or hold payouts, keep part of your balance as a reserve, require a minimum balance, or stop payouts entirely. We may do this at our discretion, including when we see a high rate of refunds or disputes, a sudden change in sales, or other signs of risk.
Refunds, disputes, and chargebacks
You're responsible for refunds, disputes, chargebacks, and the related fees for your sales. When you issue a refund or a customer disputes a charge, the amount and any fees are deducted from your balance.
Money you owe us
If refunds, disputes, fees, fines, or other amounts leave your balance negative, or you otherwise owe us money, you agree to pay it. To the extent permitted by law and our payment processor, you authorize us to recover what you owe by any available means. These include deducting it from your current or future balances and payouts, holding reserves, charging the payment method on file for your account, debiting your bank account, and pursuing collection.
Your responsibilities as a seller
- Taxes. You're responsible for determining, collecting, reporting, and paying any taxes on your sales. Repaint doesn't calculate, collect, or file taxes for you. We may send tax forms and report information to tax authorities where the law requires it.
- Your products and customers. You're responsible for your products and services, delivery and shipping, customer service, refund policies, and complying with the laws that apply to your business.
- Your policies. You're responsible for giving your customers your own terms, refund policy, and privacy policy where the law requires them.
7. Email
If you send email through Repaint, you're responsible for following anti-spam and privacy laws. That includes only emailing people who have agreed to hear from you, and honoring unsubscribe requests. We may limit, pause, or turn off email sending for any workspace at our discretion.
8. Your customers' data
Your sites and apps may collect information about your customers, like form submissions, accounts, and orders. You're responsible for that information and for having the right to collect and use it, including giving your customers any notices and getting any consents the law requires. We process that information on your behalf to provide the Service, as described in our Privacy Policy.
9. Domains and third-party services
You're responsible for any domain you connect to Repaint, including owning or controlling it and keeping it registered. If you connect other software or services to your sites, your use of them is governed by their own terms, and Repaint isn't responsible for them.
10. Suspension and termination
We may suspend or terminate your account, any workspace, website, or app, your ability to accept payments or send email, or your access to any part of the Service. We may do this at any time, for any reason or no reason, with or without notice. We may also remove or disable any content. This includes, but isn't limited to, when we believe you've violated these Terms or put Repaint, our partners, or other people at risk.
If your account is suspended or terminated, you lose access to the Service, and we may delete Your Content. Amounts you've paid aren't refunded, and anything you owe us is still owed. We may keep funds in your balance for as long as needed to cover refunds, disputes, and other liabilities.
We may also delete the content of workspaces that are paused, cancelled, or inactive, at our discretion. You can stop using Repaint and cancel your subscription at any time.
11. Copyright and abuse reports
If you believe something on a site built with Repaint infringes your copyright or trademark, or is being used for fraud or abuse, you can report it or email support@repaint.com. We respond to valid reports and may remove content and terminate the accounts of repeat infringers.
12. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. That includes warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We don't promise that the Service will be uninterrupted, secure, or error-free, that AI output will be accurate, or that the Service will meet your needs or achieve any particular result.
13. Limitation of liability
To the fullest extent permitted by law, Repaint won't be liable for any indirect, incidental, special, consequential, or punitive damages. That includes lost profits, revenue, data, or business opportunities arising from or related to the Service, even if we were told they were possible.
To the fullest extent permitted by law, Repaint's total liability for any claim arising from or related to these Terms or the Service is limited to the greater of the amount you paid Repaint in the 12 months before the claim arose or $100.
14. Indemnification
You agree to defend and indemnify Repaint, and hold it harmless, from any claims, losses, damages, fines, and expenses, including reasonable legal fees. This covers anything arising from Your Content, your websites and apps, your business and sales, your customers, your use of the Service, or your violation of these Terms or the law.
15. Resolving disputes
If you have a concern, please contact us first at support@repaint.com. Most issues can be resolved that way.
Arbitration and class action waiver
If we can't resolve a dispute informally within 60 days, you and Repaint agree to resolve it through final and binding individual arbitration, instead of in court. Arbitration will be administered by the American Arbitration Association under its applicable rules, and may be held remotely. Either party may instead bring an individual claim in small claims court if it qualifies. Either party may also ask a court to stop the infringement or misuse of intellectual property.
You and Repaint agree to bring claims only on an individual basis, and not as a plaintiff or class member in any class, collective, or representative action. The arbitrator may not combine claims from more than one person.
You can opt out of this arbitration agreement by emailing support@repaint.com within 30 days of first agreeing to these Terms.
Governing law
These Terms are governed by the laws of the State of Delaware and applicable US federal law, without regard to conflict of law rules. For any dispute that isn't subject to arbitration, you and Repaint agree to the jurisdiction of the state and federal courts located in Delaware. If you're a consumer in the European Union or United Kingdom, you also keep the protection of any mandatory laws of the country where you live.
16. General terms
- Changes to these Terms. We may update these Terms from time to time. If a change is material, we'll give reasonable notice, like by email or in the app. Continuing to use the Service after changes take effect means you accept the updated Terms.
- Sanctions and export laws. You confirm that you aren't located in a country subject to US embargoes, and that you aren't on any US government list of prohibited or restricted parties.
- Notices. We may send you notices by email or through the Service.
- Assignment. You may not transfer these Terms without our permission. We may transfer them, including as part of a merger or acquisition.
- Entire agreement. These Terms, together with our Privacy Policy and any policies they refer to, are the entire agreement between you and Repaint about the Service.
- Severability and waiver. If any part of these Terms can't be enforced, the rest still applies. If we don't enforce a right, we haven't waived it.
- Translations. If these Terms are translated, the English version controls.
